„PZSzach naruszył postanowienia przyjętego przez PZSzach nowego regulaminu PZSzach. Takie postępowanie nie mieści się nawet w postępowaniu karnym czy cywilnym. Błędna interpretacja rzeczonego regulaminu doprowadziła do błędnej decyzji prezesa PZSzach, który powołał wadliwy organ orzeczniczy. PZSzach był tego świadom. To naruszenie, na gruncie postępowania karnego, tego rodzaju wadliwość uważa się za bezwzględną podstawę do uchylenia orzeczenia; na gruncie postępowania cywilnego niewłaściwy skład orzekający jest rudymentarną (elementarną -red.) wadliwością skutkującą nieważnością postępowania”.
